The ones that come back every year
Sales with an earlier edition already on record here, or announcing at least 100 stallholders.
No recurring event is on record yet. A sale joins this list at its second published edition, or as soon as it announces at least 100 stallholders: the test is measured, not awarded.
Holding a stall, or running a sale: what French law says
A vide-grenier is, in law, a "vente au déballage" — a sale held somewhere not normally used for selling. Three rules follow from that, and they apply to a hamlet of two hundred people exactly as they apply to Troyes.
The organiser declares the sale at the town hall
The declaration is made on form Cerfa 13939*01, handed to the mayor against a receipt or sent by registered post, at least fifteen days before the date when the sale is held on private land (article R310-8 of the commercial code). A copy goes at the same time to the Aube department office for employment, labour, social affairs and public protection. Running a sale without declaring it carries a 15,000 euro fine (article L310-5).
Two months a year per site, and no more
No single site may host more than two months of déballage sales in a calendar year (article L310-2). The two months can be split up; they are cumulative, not consecutive. Going over is an offence (article R310-19). That rule, not local preference, is why a village runs one or two big days a year rather than a market every weekend.
Two sales a year for a private seller
Private individuals not entered on the trade register may take part in déballage sales "twice a year at most", and only to sell their own used personal belongings (article L310-2). This is a rule about the person, not the event: it follows you from one village to the next, and the count resets on 1 January. Newcomers are caught out by it more often than anyone else.
The sellers’ register
The organiser keeps a register recording, for every seller, their surname, first names, occupation and address, together with the type, number and issue date of the identity document produced. For a non-professional it also records that a sworn statement was handed in, declaring no participation in two other such events during the same calendar year (article R321-9 of the penal code). The register is lodged within eight days with the prefecture or sub-prefecture for the place of the event: in the Aube, at Troyes, Bar-sur-Aube or Nogent-sur-Seine, depending on the district.
Where to file the declaration in the Aube
The declaration goes to the town hall of the commune hosting the sale, however small it is. Opening hours and contact details for all 431 town halls in the department are published on this site, on each town’s page.
